What is the Roundup Lawsuit?

Roundup is the most frequently used weed-killing herbicide in the world. It is used by groundskeepers and homeowners alike on lawns, gardens, parks, and playgrounds, among many other outdoor locations. Monsanto, the manufacturer, brings in more than $6 billion in revenue per year as almost 250 million pounds of pesticide are sprayed annually.

Unfortunately, numerous scientists believe the use of Roundup increases the risk of some types of cancer. Specifically, non-Hodgkin’s lymphoma (NHL) and hairy cell leukemia. The source of the problem is the principal element in the weed killer, glyphosate. Because of the chemical glyphosate, the World Health Organization (WHO) declared Roundup a “probable human carcinogen.”

Alleging that they got non-Hodgkin’s lymphoma from Roundup, suffering users are joining a class-action lawsuit against Monsanto. If you are one of these users and you or a loved one has developed non-Hodgkin’s lymphoma or other cancers after using the weed killer Roundup, seek the guidance of an experienced Roundup class action attorney at the Greenwald Law Firm.

Roundup Weed Killer Lawsuit

Farmworkers, landscapers, plant nursery workers, and those in occupations involving frequent use of herbicides like Roundup on crops are the most at risk of developing cancer from the product. Regular residential use also puts those who use the product on their lawns and gardens at risk. Virtually anyone developing lymphoma after exposure to the main chemical, glyphosate, is the focus of the Roundup lawsuit.

Allegations in Roundup Lawsuits

Roundup is used as an all-purpose weed killer by farmers and agricultural workers, gardeners, and others. The active ingredient is glyphosate. For decades, the product’s manufacturer Monsanto denied claims that the weed killer was a human carcinogen while in fact, the company has known for decades that Roundup causes cancer. That’s according to leaked internal Monsanto emails, now known throughout the world as “The Monsanto Papers.” These emails indicate that Monsanto concealed the risks of glyphosate cancer rather than telling customers as Roundup sales continued to soar.

It’s also suggested that other medical issues such as bone cancer, B-cell lymphoma, skin cancers, DNA damage, and chromosome damage are also linked to Roundup and its primary ingredient, glyphosate.

What Kind of Cancer Does Roundup Cause?

Roundup users suffering from non-Hodgkin’s lymphoma allege Roundup directly caused their illness. With non-Hodgkin’s lymphoma, the body produces an excessive number of aberrant lymphocytes, which are a kind of white blood cell.

Signs and symptoms of non-Hodgkin’s lymphoma include:

  • Swollen lymph nodes
  • A distended belly
  • Pain in the abdomen
  • Pressure or pain in the chest
  • Cough or shortness of breath
  • Fever
  • Unusual weight loss
  • Anemia (iron deficiency)
  • Chills or night sweats
  • Chronic exhaustion
  • Vomiting and nausea
  • Lack of appetite
  • Rash on the skin
  • Headaches
  • Difficulty moving

Visit your doctor right away if you experience any of these symptoms after using Roundup. You should also speak with a Roundup lawsuit attorney to help determine whether your illness may entitle you to join the class-action lawsuit.

What is the Latest News on the Roundup Lawsuit?

The company Bayer actually bought Roundup from Monsanto back in 2018. In July 2021, Bayer said it’s phasing glyphosate out of the home, lawn, and garden market in the United States beginning in January 2023.

The company made this decision because the residential lawn and garden industry in the United States makes up more than 90% of the Roundup cases brought against Bayer in recent years. The weed killer remains available for agricultural and professional use by farmers, retailers, and others for weed management.

On June 24, 2020, Bayer announced it reached settlements with five of the main law firms bringing Roundup lawsuits, paying approximately $11 billion toward more than 100,000 lawsuits. Three trial losses in a row and a year of negotiations led to the settlements.

What is the Average Payout for Roundup Lawsuit?

Three Roundup lawsuits resulted in trials. Claimants in the three trials all received substantial compensation. Each said Roundup caused their non-Hodgkin’s lymphoma.

Dewayne Johnson was granted $289 million in 2018 for being exposed to Roundup as a groundskeeper. Edwin Hardeman was granted $80 million in 2019 after spraying the substance on his land for more than 20 years. In the case of the Pilliods couple vs. Monsanto, the plaintiffs were awarded $2 billion after using an estimated gallon of Roundup every week on their land for more than 30 years.

The awards included money for non-economic losses like pain and suffering, as well as economic losses including lost wages and medical bills. These initial settlements got the ball rolling and set the bar for possible future awards that are weighed on a points system determining damages. Each point receives a set dollar value.

Plaintiffs with a lot of exposure to Roundup, such as landscapers and agricultural laborers,  and are diagnosed with non-Hodgkin’s lymphoma are in the top tier.

The bottom tier is cases where plaintiffs have less exposure, such as homeowners, and developed other types of lymphoma or malignancies not directly linked to Roundup.

Round One settlements for a Roundup lawsuit averaged from $120,000 to $180,000.

Roundup Settlement Checks 2021

Because they were first, the earliest lawsuits got massive verdicts. Since Bayer agreed to a settlement, later monetary awards in the Roundup lawsuit will likely be millions of dollars less.

In 2021, a potential Roundup settlement may include damages for the following:

  • Medical expenses not covered by insurance
  • Pain and suffering due to your illness
  • Damages for wrongful death if the person died as a result of their cancer
  • Emotional and mental anguish
  • Lost wages

The extent of your injuries determines the amount of money you will receive in your settlement.

When Will Roundup Settlements Be Paid?

The majority of claimants negotiated an $11 billion settlement with Bayer/Monsanto. Approximately 80% of the Roundup lawsuits are settled. Some victims received settlement payouts earlier this year, while many more will get their money from the Roundup lawsuit settlement later this year or in 2022.

Is it Too Late to Join the Roundup Cancer Lawsuit?

It is not too late to join the Roundup lawsuit. The class-action case is ongoing, and the “Wave 3” Roundup lawsuit will go to trial soon.

However, a statute of limitations is set by each state to determine the deadlines for filing a lawsuit. There is a one-year statute of limitations for Louisiana personal injury claims. This means you have exactly 365 days after receiving a cancer diagnosis to make a claim in court.

If you are not diagnosed but are experiencing symptoms of non-Hodgkin’s lymphoma or other cancer-like symptoms, see a doctor as soon as possible. In your situation, the statute of limitations begins when you know or should know you are injured.
